Questa Prima Conferenza Europea è un momento importante di riflessione intorno alla complessa e problematica realtà della famiglia che si prende cura di disabili in situazione di gravità. Vorremmo affrontare l’argomento, in particolare, dal punto di vista delle famiglie che, fin dal loro costituirsi, si fanno carico dei problemi connessi alla presenza di figli gravemente disabili; situazione che si presenta a coppie spesso molto giovani, condizionandone totalmente e completamente l’esistenza. La prospettiva di vita, dominata dalla necessità di una dedizione al proprio figlio, totale, solitaria e senza alternative, espone queste famiglie, più delle altre, al rischio di crisi. La qualità della loro vita è legata soprattutto alle risorse personali morali, spirituali e di carattere che la coppia riesce a mettere in campo: quelle ambientali, amicali o familiari molto spesso si defilano, più o meno elegantemente. Le istituzioni, anche se inadeguate, e il volontariato, spesso, restano la sola speranza di supporto.
L’esperienza dell’associazione che da circa trenta anni raccoglie famiglie di disabili, in prevalenza in condizioni di gravità fisico-intellettive, ci consegna l’immagine di famiglie che, se hanno resistito unite, sono sopraffatte da problemi irrisolti che si stratificano e si aggravano con il passare degli anni. Spesso ci troviamo di fronte genitori anziani, afflitti dai mali dell’età, economicamente penalizzati dal mancato reddito di uno dei genitori (la madre nella quasi totalità dei casi), gravati dagli oneri, anche economici, dell’assistenza di adulti non autosufficienti. Abbiamo vissuto, purtroppo, anche la conclusione drammatica di qualcuna di queste vicende.
Queste situazioni sono la conseguenza di politiche disorganiche ed approssimative, di riforme incompiute, di leggi rimaste sulla carta, di intralci burocratici, di politiche sociali che fanno fatica ad interpretare la realtà sociale ed i suoi mutamenti: il tutto aggravato dalla nostra incorreggibile natura truffaldina.
La domanda “quali sono i fattori che determinano la qualità di vita in una famiglia con una persona non autosufficiente” suona francamente retorica. La famiglia fino ad oggi è stata considerata dallo Stato un servizio sociale gratuito, sulle spalle soprattutto delle donne. Tanto è vero che i permessi lavorativi previsti dall’art. 33 della legge 104/92 vengono erogati secondo modalità (quattro ore o l’intera giornata)che sembrano studiate non per coloro “che si prendono cura di un congiunto particolarmente grave che necessità assistenza continuata nell’intero arco della giornata” ma per favorire i troppi vergognosi abusi.
Aprirsi ad una prospettiva europea è nel percorso storico che stiamo seguendo ed è di fondamentale importanza per mettere a comune esperienze e buone prassi e, spiace dirlo, per assimilare quel senso civico che sembra non ci appartenga più.
Il riconoscimento giuridico del lavoro di cura, di cui oggi parliamo, finalizzato a consentire la conciliazione della vita familiare con l’attività di cura e con quella professionale, restituisce libertà di scelta e pari opportunità al familiare che si prende cura di un congiunto in condizioni di gravità: esercizio di libertà che non è alternativo rispetto ad iniziative che si muovono in favore di altre opportunità. Ad esempio, i progetti di legge in itinere che consentiranno al lavoratore che si prende cura di un disabile grave di lasciare anticipatamente il lavoro attraverso l’equiparazione dell’attività di cura ai lavori usuranti, sono una opzione, anch’essa, in linea con politiche di supporto alla famiglia. Questa ripristina infatti quella possibilità di scelta che tipicamente viene negata quando la vita familiare è condizionata dalla cura di un figlio gravemente disabile.
La qualità di vita di un a persona è quindi in relazione diretta alla possibilità di esercitare i diritti umani e di godere delle libertà fondamentali. Per le famiglie e per i familiari che si prendono cura di un congiunto gravemente disabile, tutto questo dipende in larga misura dalle Politiche Sociali nazionali e locali. Politiche che sempre più dovranno aderire ai principi fondanti della “Dichiarazione Universale dei Diritti Dell’Uomo”del 1948 ed alla recente “Convenzione dell’ONU sui Diritti delle Persone con Disabilità”. Questo, secondo noi, il percorso che porterà i disabili e i loro familiari a poter esercitare il diritto di piena cittadinanza, ad usufruire delle “pari opportunità e a godere di quella inclusione sociale, fattore fondamentale per una qualità di vita dignitosa.
